2 Years After Historic Union Vote, Bicycle Health Clinicians Still Lack a Contract

Nearly two years after voting to unionize, Bicycle Health clinicians have yet to reach a contract agreement, representatives of the Union of American Physicians and Dentists (UAPD) told Behavioral Health Business. Now, the UAPD has filed an unfair labor practice complaint (ULP) with the National Labor Relations Board, alleging Bicycle Health is bargaining in bad faith with its 57 union members.

The ULP complaint claims Bicycle Health executives engaged in delaying negotiations, withholding essential information, putting forward proposals designed to be rejected, and prematurely declaring an impasse to avoid reaching an agreement.

“The big difference that we’re having is the fact that the company wants sole discretion over a lot of mandatory subjects that you lawfully have to bargain over,” said Ryan Cave, the UAPD representative working directly with Bicycle Health’s unionized providers. “They want waiver language inside of the contract to where the company is free to make unilateral changes, and that’s just something that we as unionists, the UAPD, and our leadership at the UAPD are not going to stand for.”

Bicycle Health’s chief medical officer, Dr. Travis Schamber, has been a key executive at the table from Bicycle Health’s side of the negotiations, Cave told BHB.

“We care deeply about our employees and have bargained in good faith for 21 months to reach a fair contract,” Schamber told BHB. “During that timeframe, we conducted over 30 meetings and exchanged over 40 separate proposals with the union. This summer, at the union’s request, we presented a last, best, and final offer. We were surprised by the recent ULP allegations, and we will address them through the appropriate legal process.”

While contract negotiations have been largely stalled since Bicycle Health implemented its last, best, and final offers on multiple contract terms, including wages, retirement, non-discrimination terms, health and welfare benefits, paid sick leave, vacation, holidays, continuing medical education, on-call pay, parental leave, and other benefits.
